1. About Us
1.1 Please note that our volunteers will pack and despatch your order as soon as they can - normally within 14 working days. Please read paragraph 3 (Shipping and Handling) for further information.
1.2 We advise that you keep a printout of these terms and conditions along with details of your order, and keep them for future reference.
1.3 The following terms and conditions apply to all transactions made through the Friends of the Settle-Carlisle Line website shop. Please read through it carefully before placing your order. Please also read paragraph 8 (Privacy Policy) regarding personal information provided by you.
1.4 The Website Shop is operated by the Friends of the Settle-Carlisle Line ("the Friends"), a voluntary organisation formed to support and develop the line. All profits made will be directed to projects along the line.

2. Making A Purchase
2.1 These terms and conditions may be varied at any time without notice. Any changes will apply to any subsequent orders received.
2.2 Your order is only accepted by the Friends and these terms and conditions only become a binding contract ("Contract") once acceptance of your order has been sent to you by email and received. The Friends reserve the right to refuse your order for any reason.
2.3 This Contract represents the entire agreement and understanding between the Friends and yourself in respect of the items acquired and sold by it. It supersedes any previous Contract between us.
2.4 Each of the parties acknowledges and agrees that by entering into this Contract, it does not rely on, and shall have no remedy in respect of any statement, representation (other than a fraudulent misrepresentation), warranty or understanding (whether negligently or innocently made) other than as expressly set out in this Contract. The only remedy available for any such statement, representation, warranty or understanding shall be for breach of contract under the terms of this Contract.
2.5 The price you pay is the price displayed on this website at the time the Friends receive your order. Whilst the Friends try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled and provide a refund. If you cancel and you have already paid for the goods, you will receive a full refund. Any prices shown in this internet shop will apply until the Friends decide to change them. Any items sold at special offer prices have been sold previously either in this website shop or in the Friends' station shops at Settle and/or Appleby at the full price unless otherwise indicated.
2.6 Sometimes the product specifications from the manufacturer may change, in which case we will do our best to offer you a substitute of the same or better quality at the same price. Where applicable, you may cancel your order in accordance with your rights under the Distance Selling Regulations (see paragraphs 2.7 and 4). All sizes and measurements are approximate but we do try to make sure that they are as accurate as possible. On the rare occasion that there is an error, we will advise you about it as soon as possible.
2.7 If the item(s) you have ordered become unavailable for any reason, we will contact you and advise you of this. We will not send replacement items without your consent.
2.7.1 If you have agreed to accept a replacement item, you shall accept these in lieu of the goods ordered without any further remedy other than a refund if the replacement item is cheaper than the goods ordered.
2.7.2 If you do not agree to accept a replacement item, we will refund you the cost of that item within 30 days.
2.8 We do not guarantee that this website shop will be compatible with your PC, and we accept no liability for any corruption or loss of data held on your PC, or any liability for any other loss or damage of any kind caused to your PC resulting from use of the website shop.
2.9 Any claim for damages against the Friends will be limited to a claim under this Contract for the total transaction value for your order, however we do not exclude or limit liability for death or personal injury or for fraudulent misrepresentation.

3. Shipping And Handling
3.1 Orders placed with us are normally sent by first class post to UK addresses. Please request any particular delivery instructions in the Special Requirements section on the Checkout payment method page.
3.2 Please note that our volunteers will pack and despatch your order as soon as they can - normally within 14 working days. We aim to deliver all goods within 28 days, and will notify you of any delays.
3.3 Membership and gold card applications are post free.
3.4 Our UK and overseas postage charges vary for different products and are shown in the Checkout section of the website shop.

4. Your right to cancel your order
4.1 The The Consumer Protection (Distance Selling) Regulations 2000 provide you with a right to cancel your order. This right is effective from when you place your order until seven working days after you have received your order. Please contact us by email, post or fax if you wish to exercise your right to cancel, using the contact details provided in section 7 - but note that the right cannot be exercised by phone. You must return the item(s) to us in the same condition in which they were sent to you.
4.2 This right does not apply to:
* memberships of the Friends which will be processed and effective before the 14 working day period ends; and
* CDs, videos and DVDs or other recordable media unless they are faulty, in which case please refer to our returns policy in section 9.
4.3 If you cancel your order we will provide a refund of the cost of the item(s) within 30 days and upon receipt of the goods from you. You must pay the cost of the return postage, and our refund will not include the original post and packing charges for the item(s). If you do not return the item(s), we reserve the right to charge you for our recovery costs which may cancel out any refund due.
5. Tax Charges
You will be liable to pay any import or export charges levied and which we do not invoice you for.

6. Credit Card Security
6.1 All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption.
6.2 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
6.3 Payment can be made by credit card via our secure server or by cheque.

8. Privacy Policy
We do file details of your order. Please read our Data Protection Policy for details of how these can be obtained. We process data in compliance with the Data Protection Act 1998.

9. Returns Policy
9.1 In case of a query or problem with your order, please contact us first. We will aim to respond to your query as soon as possible, and to your satisfaction. If you have a query upon receipt of your goods, please contact us within 7 days of receipt.
9.2 If the item(s) have their specifications changed by the manufacturer, your rights are set out in paragraph 2.6.
9.3 If the items become unavailable, your rights are set out in paragraph 2.7.
9.4 If there is a defect with your goods, the Friends will normally replace the item provided that the Friends receive the item back from you. Please note that you will be required to pay the postage back to us. However, if the Friends determine that there is a defect with the item then the Friends will provide a replacement and pay for the cost of the return postage of the replacement item only.
9.5 If the delivery you receive does not correspond with your order, please contact us.
9.6 None of the above prejudices any of your statutory rights.
10. Waiver
Any delay or inaction in enforcing the Friends' rights against you shall not be interpreted as a waiver and shall not prejudice any of the Friends' rights under this Contract.
11. Force Majeure
The Friends shall not be liable to you for any delay to or non-performance of its obligations under this Contract due to circumstances outside our control, including (without limitation) emergencies, acts of God, strikes, war, riots and terrorism.
12. Jurisdiction and Law
This Contract shall be governed by the laws of England and Wales and any dispute between us will be resolved exclusively in the courts of England and Wales.
